Florida Senator Carlos Smith (D) has introduced legislation that would allow registered medical marijuana patients to cultivate cannabis at home, marking a major step toward expanding patient rights in the state’s cannabis program. Under the proposal, qualified patients aged 21 or older could grow up to six flowering plants for personal, therapeutic use, with seeds and clones available from licensed dispensaries. The bill, filed for the 2026 session, stipulates strict security requirements to prevent unauthorized access and would take effect on July 1, 2026, if passed.

A similar measure failed earlier this year, but the move comes amid renewed efforts to place a revised legalization initiative on the 2026 ballot.
